The Supreme Court of India has summoned the chief secretaries of Delhi, Andhra Pradesh, and Jammu and Kashmir due to their failure to act against misleading advertisements of Ayurvedic, Siddha and Unani drugs.

The summon was issued by a bench comprising Justices Abhay S Oka and Ujjal Bhuyan, who stated that the court's orders had not been implemented. The top court has ordered these chief secretaries to appear via video-conferencing to explain the non-compliance.

"As rightly submitted by the amicus curiae, the issue of illegal advertisements of Ayurvedic, Siddha or Unani drugs will be substantially taken care of, if all the states start implementing Rule 170 of the Drugs and Cosmetics Rules, 1945 in its true letter and spirit. Notwithstanding several orders passed by this court, the states are non-compliant," the bench stated.

The matter has now been posted for March 7, 2025,aaajili login giving the states three weeks to file their response.

What Is The Order?

On August 27, 2024, the Supreme Court of India clamped down on misleading advertisements and stayed a notification issued by the Ministry of AYUSH omitting Rule 170 - which prohibits misleading advertisements of Ayurvedic, Siddha, and Unani drugs.

This notification issued by the AYUSH ministry was in contradiction to an order issued by the court earlier in May 2024.

In May 2024, the top court stated that before an advertisement was permitted, a self-declaration must be obtained from the advertisers based on the Cable Television Networks Rules of 1994.

Similarly, a misleading ads case was filed against Patanjali Ayurveda Limited, Baba Ramdev, and Acharya Balkrishna for publishing misleading advertisements for their products. The case was closed in August 2024 after the parties issued an unconditional apology for their doing.
